Terms of Use

Last updated: 9 October 2026 · Governing law: Poland
⚠ Important, guidance only
  • Tool outputs must not be used as final project documents without review by a qualified professional
  • Outputs are drafts and must be reviewed by a competent person before use. Our liability is limited - see clause 8.
  • Use at your own professional discretion

1. Acceptance of Terms

You must be at least 18 to use this Service. By accessing or using FitOut Insider you agree to be bound by these Terms. If you do not agree, you must not use the Service. FitOut Insider is operated by Dariusz Kubies Services (JDG), al. Solidarności 68 lok. 121, 00-240 Warszawa, Poland. NIP 7532202127, REGON 544086256.

2. Who This Service Is For

2.1 Business customers. You can subscribe for your business, trade, craft or profession. If you do, you confirm that you are acting in that capacity and that you are authorised to accept these Terms for the business or organisation you are subscribing for. The consumer cancellation rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 do not apply to business customers. 2.2 Personal customers. You can also subscribe to the Solo plan for yourself, for example to use the tools in your own job, and pay for it yourself. If you do, you are a consumer and clause 16 (Personal customers) applies to you as well as these Terms. Where clause 16 and the rest of these Terms differ, clause 16 applies. 2.3 You choose which applies to you when you sign up. You must choose correctly and tell us at hello@fitoutinsider.com if it changes. 2.4 You also confirm that the country you give us when you subscribe (where your business is registered, or where you live if you are a personal customer) is correct, that it remains correct for as long as your subscription continues, and that you will tell us at hello@fitoutinsider.com if it changes.

3. Nature of the Service

FitOut Insider provides AI-powered document generation and analysis tools for the UK fit-out and construction industry, to assist qualified professionals in creating draft documents, checklists, registers, programmes, and plans. All outputs are for guidance and reference only.

4. Guidance Only, No Professional Advice

IMPORTANT: All outputs are for guidance only and must not be relied upon as professional health & safety, legal, engineering, or commercial advice. H&S tools (RAMS, Fire Risk Assessments, Permit to Work, CDM notifications, etc.) produce AI-generated drafts that must always be reviewed, validated and approved by a competent person before use on a live project. Outputs are drafts. We do not guarantee that any output is accurate, complete or suitable for your project, and you must check every output as this clause and clause 10 require. This does not limit clause 8.1 or, for personal customers, clause 16.6.

5. User Responsibilities

You are solely responsible for: ensuring outputs are reviewed by qualified professionals; compliance with all applicable laws (incl. the Health and Safety at Work Act 1974, CDM 2015); the accuracy of your inputs; lawful use; not reverse-engineering or scraping the Service; not generating misleading content; and not sharing account credentials beyond the seats purchased on Team or Business plans.

6. Subscriptions, Trial and Payment

New subscriptions start with a 14-day free trial. A payment card is required at signup but is not charged until day 15; the trial converts automatically to a paid subscription at that point unless cancelled first - except where access is granted by invitation, in which case no card is taken and the trial does not auto convert. Subscriptions are available only to customers whose billing address is in the United Kingdom. If the billing address on your payment method is outside the UK when your free trial ends, we cancel the subscription before any payment is taken and you are not charged. A new subscription does not include another free trial. No separate refund window applies, except for personal customers under clause 16. Nothing is charged until day 15, and the subscription can be cancelled at any point before then at no cost. Access requires a paid subscription thereafter, billed monthly or annually via Stripe, per seat on Team and Business plans. Cancel at any time from account settings. Cancelling stops your subscription renewing; clause 7B.1 explains what happens to the period you have already paid for. Your access to the Platform ends when your subscription ends. Solo is for use by a single named individual; Team and Business plans provision multiple named seats on a shared workspace, within that plan's seat band. When your subscription ends, access to the Platform ends immediately. Your saved documents and project registers are kept for a further 90 days. If you resubscribe within those 90 days your access is restored and your data is exactly as you left it. If you do not, your data is permanently deleted at the end of that period and cannot be recovered. Deleting your account ends your subscription straight away - see clause 7B.1. Your data is destroyed at once and the 90 day period above does not apply. This does not apply to the records described in clause 1.6 of the Data Processing Agreement, which we are required to keep for tax and accounting purposes and which are retained and deleted in accordance with that clause. A small number of records are kept after deletion for the periods and reasons set out under Data retention in our Privacy Policy. Deleted database records may remain in a disaster-recovery backup, inaccessible, for up to seven days before they are overwritten. Billing, invoice and transaction records: retained for 7 years. This covers both the Polish statutory minimum, which runs 5 years from the end of the year in which the tax became due, and the UK VAT record-keeping requirement of 6 years. Records of safety notices and terms you accepted are retained separately and for longer. See Data retention in our Privacy Policy. Referral scheme. If you take part in our referral scheme, the referral terms at /legal/referral apply and form part of these Terms.

7. Your Anthropic API Key

What you must provide. The Platform generates documents and other outputs using artificial intelligence services supplied by Anthropic PBC ("Anthropic"). To use those features you must obtain your own Anthropic API key and connect it to your account. When we pay for the AI. In two cases the AI features run on our own Anthropic account, at no cost to you: during your free trial, and in the support chat if you have not connected your own key. Free trials run on a shared monthly AI budget across all trial accounts, and each trial account also has its own usage limit. If either is reached, AI features on your trial may pause until the next month or until you subscribe. You are not charged for a trial in any case. When a limit is reached, or your trial ends, you need your own Anthropic API key to keep using the AI features. Apart from these two cases, we do not supply, resell, or include an API key or any usage allowance in your subscription. Your relationship with Anthropic is direct. By obtaining an API key you enter into a separate agreement with Anthropic on Anthropic's own terms. Anthropic bills you directly for your usage at the rates Anthropic publishes. We are not a party to that agreement, we receive no share of what you pay Anthropic, and we add no margin to it. You are responsible for your usage costs. All charges arising from use of your API key are yours, including charges arising from your use of the Platform. Any cost estimates we publish are guidance based on typical use. They are not a quotation, a cap, or a commitment, and your actual costs will depend on how you use the Platform and on Anthropic's prices from time to time. You must comply with Anthropic's terms. Your use of your API key through the Platform is subject to Anthropic's terms of service and usage policies as well as these Terms. Where the two conflict in relation to your use of Anthropic's services, Anthropic's terms govern that use. What happens without a working key. Your subscription gives you access to the Platform. Features that generate output will not function until a valid, funded API key is connected, and will stop functioning if your key is removed, revoked, expires, exceeds a limit set by Anthropic, or runs out of credit. None of these is a failure or interruption of the Platform, and none gives rise to a refund or a credit. How we handle your key. We encrypt your API key before storing it. We do not display it again after saving, we do not return it to your browser, and we use it only to perform the operations you request through the Platform. We delete it when you remove it or when your account is closed. You remain responsible for keeping your key confidential, for revoking it if you believe it has been compromised, and for monitoring your own usage and spending in your Anthropic account. Third party availability. Anthropic may change its prices, models, terms or service availability at any time, and may suspend or terminate your account with it. We have no control over any of that. Where a change by Anthropic materially affects the Platform we will tell you, but we do not warrant the continued availability, pricing or behaviour of any third party service. Data protection is unaffected. Using your own key changes who pays Anthropic. It does not change how your data is handled. Content you submit through the Platform is transmitted to Anthropic in order to generate your output, and Anthropic therefore remains a sub-processor as described in our Privacy Policy and our Data Processing Agreement. Nothing in this clause reduces our obligations, or yours, under those documents.

7A. Connected Services

The Platform can connect to third party services you already use, including accounting, project management and messaging services. Connecting one is optional and entirely your choice. When you use a connected service through the Platform, you must also follow that provider's own terms and acceptable use rules. The data protection position when you do is set out in clause 7.6 of the Data Processing Agreement. Invoices and financial entries we create in a connected accounting service are for you to check before you use them. In Xero we create them as drafts. Project-management connections (Procore, Autodesk) only read your data, and Microsoft Teams and Slack only receive notifications from us. You remain responsible for the accuracy of your own accounting, tax and statutory records. You can disconnect a service at any time from account settings. Disconnecting stops future transfers but does not remove data already transferred, which you must delete in that service yourself.

7B. Suspension and Termination

7B.1 Ending your subscription. You may end your subscription at any time from account settings. It then stops renewing, and you keep access until the end of the period you have already paid for. Deleting your account also ends your subscription, but with immediate effect: your access stops straight away, including for any time you have already paid for. Deleting your account does not cancel any amount you already owe us. We do not refund any part of a period already paid for, except where these Terms say so (clauses 7B.2, 12.4 and 16, and clause 7.3 of Schedule 1 to the Data Processing Agreement). If you reduce your seats or move to a cheaper plan during a period, the difference is credited to your next invoice. 7B.2 Ending this agreement. We may end this agreement by giving you 30 days' written notice. If we do, we will refund the unused part of any period you have already paid for. 7B.3 Suspension and termination for cause. We may suspend your access to the Service, or end this agreement, immediately, if: (a) any sum due from you is unpaid 14 days after its due date; (b) you are in material breach of this agreement and, where the breach can be put right, you have not put it right within 14 days of us asking; (c) your use of the Service exposes you, us or a third party to a legal, regulatory or insurance risk that we are not willing to carry; (d) you become insolvent, or a step is taken towards your winding up, administration or the appointment of a receiver; (e) you, or anyone using your account, shares login details or lets more people use the Service than the number of seats you have paid for, unless, within 7 days of our notice, you buy the additional seats or stop the sharing; (f) you, or anyone using your account, copies or extracts content or data from the Service by automated means, including scraping, crawling or bulk downloading, other than through features we provide for that purpose; or (g) you, or anyone using your account, uses the Service unlawfully or abusively, including trying to get round its security or usage limits, or in a way that harms or is likely to harm the Service, us or other users. 7B.4 What suspension means. While your access is suspended your subscription continues and fees remain payable. We will restore your access as soon as the reason for the suspension has ended. We will tell you that we have suspended your access and why, unless the law prevents us from saying so. 7B.5 When this agreement ends. Your right to use the Service ends. If you ask us within 90 days of the agreement ending, we will provide you with a copy of your data. Your data is then retained and deleted as described in clause 6, except for the records described in clause 1.6 of the Data Processing Agreement.

7C. Project rooms and guests

7C.1 You can invite people outside your organisation (guests) into a project room for one of your projects. You decide what each guest can see. You are responsible for what you share with guests and for having the right to share it, including other people's personal details in drawings, documents and files. 7C.2 Guests use a project room for you and under your control. You must make sure they use it only for the project and do not share their access or the content outside the project team. You can remove a guest at any time; their access stops straight away. 7C.3 Guests do not pay and are not seats. The number of guests a project room can have is shown in the Service. 7C.4 We handle guests' details for you under the Data Processing Agreement, except our own security records of guest sign-ins, which we handle as described in our Privacy Policy.

8. Limitation of Liability

8.1 What we do not limit. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded. 8.2 What we are not liable for. Subject to clause 8.1, and because all outputs are guidance only and must be reviewed by a competent person before use as set out in clauses 4 and 10, we are not liable for any loss arising from your use of, or reliance on, any output that has not been so reviewed and approved. 8.3 Types of loss we exclude. Subject to clause 8.1, we are not liable for loss of profit, loss of revenue, loss of anticipated savings, loss of contract, loss of goodwill, loss or corruption of data, business interruption, or any indirect or consequential loss, in each case however arising. 8.4 Our total liability. Subject to clause 8.1, our total liability to you for all claims arising in any twelve month period, whether in contract, tort including negligence, breach of statutory duty or otherwise, is limited to the greater of the total fees you paid us in the twelve months before the claim arose, or one thousand pounds. 8.5 Your responsibility. You will indemnify us against claims brought by a third party arising from your use of the Service in breach of these Terms, or from your use of an output that has not been reviewed and approved by a competent person.

9. Intellectual Property

The platform, its design, code, and tool structure are the IP of Dariusz Kubies Services. You retain ownership of project-specific data you input. Outputs may be used freely for your professional purposes, subject to Clause 4. You may not reproduce, distribute, or commercially exploit the platform without written permission. Outputs generated for you belong to you. Where an output is generated through our own Anthropic account (during your free trial or in the support chat), we transfer to you any rights we hold in it. Templates. If you upload a template, you keep all rights in it. You give us a limited right to store it and use it only to produce your own documents in the Service, and you confirm that you are entitled to use it in this way. We do not use your templates for any other purpose or show them to anyone outside your organisation.

10. AI-Generated Content

Outputs are generated by AI language models (Anthropic Claude) and may contain inaccuracies, omissions, or outdated information. You must verify outputs reflect current applicable legislation, regulations, and contractual frameworks for your project.

11. No Warranty

The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant the Service will be uninterrupted or error-free.

12. Changes to These Terms

12.1 We may change these Terms. Where a change is material we will tell you in the Service, and you will be asked to accept the changed Terms the next time you sign in. The change takes effect for you when you accept it. 12.2 If we increase the price of your subscription we will tell you by email at least 30 days before the start of the renewal period in which the new price first applies. You may end your subscription with effect from the end of your current period at any time before that renewal begins, and the increase will not apply to you. 12.3 Changes that correct an error, or that clarify these Terms without altering their substance or reducing your rights, take effect when we publish them. We do not ask you to accept those again. 12.4 If you do not wish to accept a change you may end your subscription. If you do so within 30 days of being asked to accept it, we will refund the unused part of any period you have already paid for.

13. Governing Law

The parties will first attempt good-faith negotiation for 30 days, then mediation by agreement. Failing that, these Terms are governed by the laws of Poland, subject to the jurisdiction of the Polish courts. Nothing in this clause affects any mandatory provision of law that applies regardless of the parties' choice of governing law.

14. Force Majeure

FitOut Insider is not liable for failure or delay resulting from causes beyond our reasonable control, including acts of God, third-party infrastructure or AI API outages, cyberattacks, or changes in law.

15. Contact

For any questions regarding these Terms, contact: hello@fitoutinsider.com

16. Personal customers

This clause applies only if you subscribed as a personal customer under clause 2.2. 16.1 Your legal rights. Nothing in these Terms affects your legal rights as a consumer. We must provide the Service with reasonable care and skill, and as described to you. 16.2 Your right to cancel. You can cancel your subscription within 14 days after the day you subscribe, without giving a reason. Your free trial counts towards these 14 days. If you subscribe with a free trial, you are first charged on day 15 and your right to cancel lasts until the end of that day, so you can still cancel on the day you are first charged. 16.3 Starting straight away. When you subscribe you ask us to start the Service straight away. If you cancel under clause 16.2 after you have been charged, we will refund what you paid, less a fair amount for the days you used before you told us. If you subscribed with a free trial and cancel within the period in clause 16.2, we refund in full any payment we have taken. 16.4 How to cancel. Cancel in Settings > Usage & Plan > Manage billing, email hello@fitoutinsider.com, or use the model cancellation form at /legal/cancellation-form. Any clear statement is enough. We will refund you within 14 days of receiving your notice, to the card you paid with. 16.5 Prices. Prices shown to personal customers include VAT. 16.6 Our liability to you. If we break these Terms or fail to use reasonable care and skill, we are responsible for loss or damage you suffer that is a foreseeable result. Loss or damage is foreseeable if it is obvious that it will happen, or if we both knew it might happen when you subscribed. Clause 8 applies to you only so far as the law allows, and clause 8.5 (your responsibility) does not apply to you. 16.7 How the Service may be used. The tools produce drafts for work in the construction industry. Clause 4 and clause 10 apply to you in full: a competent person must check every output before it is used. If you enter details about other people, you are responsible for having the right to do so, and we handle that information for you on the terms of our Data Processing Agreement. 16.8 Where you can bring a claim. If you live in the United Kingdom, you keep the protection of the rules of the law of the part of the United Kingdom where you live that cannot be excluded by agreement, and you can bring proceedings in the courts there as well as in Poland. 16.9 Changes. If we change these Terms under clause 12, you can end your subscription under clause 12.4 before the change takes effect. 16.10 Suspension. If we suspend your access under clause 7B for a reason that is not a breach of these Terms by you, you do not pay for the period of the suspension, and we will refund or credit anything you have already paid for it.
